Madonna left Malawi on her private jet Sunday after being rebuffed in an attempt to adopt a second child from the poor African nation, air traffic control officials said.

Police roadblocks prevented reporters from approaching the airport but one police officer said Madonna carried David, her adopted Malawian son, up the steps of the Gulfstream jet.It was bound for London's Gatwick Airport, air traffic officials said, speaking on condition of anonymity because they were not authorized to speak to journalists.

The singer's lawyer has said that she will appeal against a court ruling that she is not eligible to adopt a three year old orphan girl, Chifundo "Mercy" James, because she hasn't lived in Malawi.Madonna first spotted Mercy during a 2006 visit to an orphanage where she found David.

Then, unlike now, she was able to leave the country with the infant and the adoption was completed last year.But now Madonna is a single mother after her split from film director Guy Ritchie. Her attempts to adopt a second child caused outrage among some child welfare groups.In a ruling Friday, Judge Esme Chombo said Madonna did not meet Malawi's strict definition of "resident." Noting that Madonna had last visited Malawi in 2008, the judge said the pop star "jetted into the country during the weekend just days prior to the hearing of this application."Malawi requires prospective parents to live in the country for 18 to 24 months while child welfare authorities assess their suitability - a rule that was bent when Madonna was allowed to take David to London in 2006. Madonna has two other children, Lourdes, 12, and Rocco, 8.No date has been set for a court hearing to appeal the judge's ruling.Madonna threw a farewell party Saturday at the luxury lodge where she was staying. Traditional dancers entertained guests including government officials and staff from Madonna's Raising Malawi charity.The charity helps feed, educate and provide medical care for some of Malawi's more than 1 million orphans, half of whom have lost parents to AIDS.

Madonna is apparently throwing a party in Malawi in a bid to swallow her disappointment that a judge rejected her application to adopt a young orphan. Traditional dancers have arrived at the luxury lodge where the pop diva is staying, as well as government officials and members of staff of her Raising Malawi charity.Amid strict security, there was no immediate confirmation on whether it was a farewell party.Air traffic control authorities granted clearance for Madonna's jet to depart Saturday but the star stayed in the lodge all day. Her lawyer has said she will appeal against Friday's judgment that she could not adopt a 3-year-old girl because she had not been resident in Malawi.

Guy, 40, felt so strongly that he issued a statement today. He said: “Madonna is a fantastic and loving mother who cares deeply about her own children, and children who may need additional help and support. “I fully supported her decision to apply for this adoption and I am saddened her application was rejected.”

“Madonna is motivated only by being a caring parent who seeks to share some of the advantages life has given her. There will be other opportunities and I wish her well in them.”

Madonna has already filed her appeal following the Malawi judge's ruling that she can´t adopt Mercy James, her lawyer confirms."We are very surprised with this ruling," Alan Chinula, Madonna's attorney, told Us he didn't see "any law in Malawi that [could] stop" the adoption. But Judge Esme Chombo cited requirements that adoptive parents reside in the country for 18 to 24 months

Human rights groups, which had charged Madonna was using her celebrity status to bypass laws, are cheering the decision."The judge has sent the right message that we have laws in Malawi that have to be respected," Undule Mwakusungura, the chairman of the Human Rights Consultative Committee, tells Us. "We can't just have people flying in and out with our children without procedure," he adds. In her ruling, the judge points out Madonna arrived in Malawi just last Sunday, and hadn't been in the country since she adopted David Banda, 3, in 2006. "Madonna may have the best interests for the girl, but pedophiles may take advantage of adopting here if we allow procedures to be bent," added HRCC Executive director Mabvuto Bamusi.But Women and Child Welfare minister Anna Kachikho, who oversees the country's adoptions, says she's "shocked by the ruling."I don't see what's wrong for Madonna to take one child as her own," she told Us. "She has not used the back door."

Kachikho points out the singer's organization Raising Malawi is assisting over 25,000 orphans in the poverty-stricken nation. The country's information minister Patricia Kaliati said yesterday: "We support her adoption process. Madonna's been good to us ... and she's proved she can take care of David."So why was Madonna allowed to adopt David but not Mercy?"It's a shocker, but [Chombo] belongs to the old school; she is very religious and a moralist," a source at Malawi's High Court tells Us. "She might not be in favor of Madonna's lifestyle of getting in and out of relationships and her semi-nude stage antics." Madonna divorced Guy Ritchie earlier this year.

 

  No Mercy for Mo
 

In a surprise move, a judge rejected Madonna's request to adopt a second child from Malawi and said it would set a dangerous precedent to bend rules requiring that prospective parents live here for some period. The judge then said he still thought she was great in "Mr. and Mrs. Smith."Madonna's lawyer, Alan Chinula, said later Friday he's filed an appeal. He said no date was immediately set. The country's child welfare minister had come out Thursday in support of the pop star's application to adopt 3-year-old Chifundo "Mercy" James. But in a lengthy ruling Friday, Judge Esme Chombo sided with critics who have said exceptions should not be made for the star, who has set up a major development project for this impoverished, AIDS-stricken southern African country.Chombo said foreigners have adopted children from Malawi, but the only case in which some residency requirement was waived was when Madonna took David Banda out of the country in 2006 before that adoption was finalized in 2008. "It is necessary that we look beyond the petitioner ... and consider the consequences of opening the doors too wide," the judge said. "By removing the very safeguard that is supposed to protect our children, the courts ... could actually facilitate trafficking of children by some unscrupulous individuals." Yeah ... it's important to keep impoverished orphans safe from the wealthy good life.The judge praised the "noble" work Madonna's charity has done to feed, educate and provide medical care for some of Malawi's more than 1 million orphans. Chombo said the girl is receiving "suitable" care in an orphanage, which contrasted with David's situation. Madonna first traveled to Malawi in 2006 while filming a documentary on the devastating poverty and AIDS crisis, and later decided to adopt children from the country. After the ruling Friday, journalists saw Madonna, looking relaxed and even cheerful, touring a village near Lilongwe, where she is building a school. She did not speak to reporters. Reports later Friday said she planned to appeal the ruling. Critics accused Madonna of using her fame and money to fast-track the adoption, but the singer said she had followed standard procedures. She faced similar allegations when she brought home David, who is now 3. In court papers, Madonna said Chifundo's grandmother was unable to care for her. The girl's mother, according to the affidavit, died at age 14 not long after her baby was born. There was no mention of the father in the affidavit.

Madonna's bid to adopt another Malawian child has been approved. High Court Judge Esme Chombo is not due to make an official ruling on the adoption of four-year-old orphan Mercy James until Friday, but Chombo has reportedly told the singer she will be granted custody. A senior Malawian official said: "This is all very confidential, and Judge Chombo must still make her ruling - but that ruling will be in favor of Madonna.""Madonna is a very good mother and ambassador for Malawi. She has improved the lives of thousands of orphans."

The 50-year-old star was photographed with Mercy for the first time Tuesday and the child is believed to be spending all her time with Madonna and the pop beauty's other children - Lourdes, 12, Rocco, eight, and three-year-old David, who was also adopted from Malawi.Madonna spent an hour in court in the African country's capital Lilongwe on Monday, telling Chombo she would be "a deeply loving mother" to Mercy, whose Malawian name is Chifundo.In adoption papers, the singer said: "To deny Chifundo the opportunity to be adopted by me could expose her to hardship and emotional trauma which is otherwise avoidable."Madonna and her family - including her new daughter - are expected to fly to Britain on Saturday and the "4 Minutes" hitmaker has reportedly told staff at her London home to "prepare for the arrival of my new little girl."Madonna - who has been accused of using her fame to bend Malawi's adoption laws to her advantage - knew her decision to adopt a second child would attract criticism but insisted she didn't care.Her friend, British filmmaker Ben Fellows, said: "Once Madonna puts her mind to something, she achieves it - and this adoption is no different.""She told me she thought it was very important that David had a sister from the same background as him and she had unconditional love to give another child.""She knew exactly what she was walking into. Pop star Madonna is not receiving any special treatment to help speed the process of adopting a young girl in Malawi, her spokeswoman has said.
Liz Rosenberg said the star was 'not skirting any legal issues' in trying to adopt four-year-old Mercy James.
A Malawian judge held a closed-door hearing on Monday on the star's adoption application but delayed ruling until Friday.
'The adoption process for Mercy began over a year ago when Madonna met her on one of her visits to Malawi. The connection was instant and profound,' Rosenberg told Reuters.
'Madonna's desire to adopt Mercy is totally heartfelt. She is not skirting any legal issues in her application to adopt this child and is looking to provide a loving family environment and the best education and health care possible,' she added.
Mercy has been living in an orphanage since her 18-year-old mother died shortly after giving birth, according to the child's uncle, John Ngalande.
Her father is believed to be alive but has little contact with his daughter, he said.
The Human Rights Consultative Committee (HRCC) has criticised Madonna's adoption attempts, saying that adoption should be the last resort and that children need to be taken care of by their own family.
'Mercy James is a child who has her extended close family members alive and we urge Madonna to assist the child from right here,' it said in a statement.
Earlier this week, the chairman of the HRCC said the star had 'the money and the status to use her profile to manipulate, to fast-track the process'.
But others have said that the adoption would give enormous opportunities to the child that she would be unable to achieve in the impoverished country.
